Terms and Conditions of Sale

Article 1. Purpose

These Terms and Conditions of Sale govern the contractual relationship between:

La Collectionnerie, a simplified joint-stock company with share capital of €1,000, registered with the Cusset Trade and Companies Register under number 944 640 218, whose registered office is located at 12 rue du Jura, 03300 Cusset, France, hereinafter referred to as “the Seller”, operating the website www.coeurdecollection.fr,

and

any individual or legal entity making a purchase through the website www.coeurdecollection.fr, hereinafter referred to as “the Customer” or “the Buyer”.

These Terms and Conditions of Sale define the rights and obligations of the parties in connection with the online sale of goods offered by the Seller to the Customer.

Any order placed on the website implies the Customer’s full, complete and unconditional acceptance of these Terms and Conditions of Sale. The Customer acknowledges having read them before placing an order.

These Terms and Conditions of Sale are available at all times on the website at the following address: https://www.coeurdecollection.fr/content/3-conditions-generales-de-vente, where they may be downloaded, printed and retained.

Article 2. Products

The products offered for sale are those displayed on the website www.coeurdecollection.fr, subject to stock availability or the manufacturing possibilities indicated on the relevant product pages. The Seller reserves the right to amend the product range at any time.

Each product is presented on the website with a description setting out its main characteristics, including its dimensions, materials, finishes, availability and estimated delivery time.

The display cases and furniture offered by Cœur de Collection may present slight variations due to the nature of the materials used, particularly wood, as well as the handcrafted manufacturing and finishing process. The photographs are intended to be as accurate as possible but cannot guarantee a perfect resemblance to the delivered product, particularly with regard to colour variations, wood grain, reflections, finishes or appearance under different lighting conditions.

These natural or handcrafted variations do not affect the product’s conformity, provided that it corresponds to the essential characteristics stated on the product page.

Products are offered for sale within the territories to which the Seller agrees to provide delivery.

Article 3. Prices

The product prices displayed on the website are expressed in euros and include all applicable taxes, including VAT at the rate in force on the date of the order. Any change in the applicable VAT rate may be reflected in the product prices.

The prices shown do not include delivery charges, which are invoiced separately and displayed before the order is confirmed.

The Seller reserves the right to change its prices at any time. However, the price shown in the catalogue on the date the order is placed shall be the only price applicable to the Customer.

The displayed prices include the environmental eco-contribution associated with the furniture recycling scheme. The amount of this contribution is shown separately on the product page and on the invoice.

Article 4. Orders and payment terms

Placing an order requires the creation of a customer account. The Customer agrees to provide accurate and complete information when registering.

The Customer may place an order through the website by adding the desired products to their basket and following the checkout process.

The following payment methods are accepted:

  • Bank card through PayPal’s secure payment system,
  • PayPal account.

The order shall be considered final once payment has been approved.

An order confirmation shall be sent to the Customer by email.

Article 5. Retention of title

The Seller shall retain ownership of the products sold until the full purchase price has been received and cleared by the Seller.

Article 6. Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, consumer Customers have a statutory period of 14 calendar days from receipt of their order in which to exercise their right of withdrawal, without having to provide a reason.

La Collectionnerie extends this period to 30 calendar days for standard products that are in stock or have not been customised.

The Customer may notify the Seller of their decision to withdraw by means of any clear and unambiguous statement, including by email or post. A standard withdrawal form may also be made available to the Customer.

However, in accordance with Article L221-28 of the French Consumer Code, the right of withdrawal may not be exercised in relation to products made to the Customer’s specifications or which are clearly personalised. This exception applies in particular to custom-made furniture, furniture adapted to a specific request from the Customer or products involving specific choices of dimensions, finishes, colours, fittings or personalisation.

Where the right of withdrawal is validly exercised, the refund shall be issued within a maximum of 14 days following recovery of the product by the Seller or receipt of proof that it has been returned.

The direct cost of returning the product shall remain payable by the Customer, except where the product is defective or does not conform to the order. Due to the fragile and bulky nature of the display cases, the Customer must contact Cœur de Collection before making any return so that the practical arrangements for collecting or returning the furniture can be organised. The product must be returned in a condition that allows it to be resold, suitably protected and without any sign of use, damage or alteration.

Article 7. Delivery

Products shall be delivered to the address provided by the Customer when placing the order, provided that the address is located within the delivery area offered by Cœur de Collection.

Display cases are delivered directly by the Cœur de Collection team. Due to the fragile, bulky and high-end nature of the furniture offered, the Seller does not entrust these products to a standard carrier unless a specific prior agreement has been reached with the Customer.

Delivery times vary according to the availability of the furniture ordered, as stated on the product page at the time the order is placed:

  • for furniture available in stock, the delivery time is 30 to 45 days from confirmation of the order;
  • for furniture that is not available in stock and requires manufacturing, preparation or specific provision, the delivery time is 3 to 6 months from confirmation of the order.

Once the order has been confirmed, the Seller shall contact the Customer to arrange the practical details of delivery. The Customer agrees to provide an accurate, complete and accessible address, together with a telephone number that can be used to organise delivery. The Customer is responsible for ensuring that the delivery location allows access and passage for the furniture ordered, particularly with regard to doors, staircases, corridors, lifts and parking conditions.

At the time of delivery, the furniture shall be carefully placed at the delivery location by the Cœur de Collection team. The Customer is invited to inspect the apparent condition of the product upon receipt and immediately report any visible issue. This inspection does not affect the application of the statutory guarantees.

The risk of loss of or damage to the product shall pass to the Customer when the Customer, or a third party designated by them, takes physical possession of the product.

In the event of a delay in delivery beyond the stated delivery time, the Customer may require the Seller to complete delivery within a reasonable additional period. If delivery does not take place within this additional period, the Customer may cancel the sale and obtain a refund of the sums paid, in accordance with the conditions provided by law.

In accordance with the applicable regulations, as our company is a craft business with turnover below the statutory thresholds at which a take-back service becomes compulsory, we do not offer collection of old furniture at the time of delivery. To recycle your old furniture, please contact the nearest Écomaison collection point or household waste recycling centre.

Article 8. Guarantees

All products are covered by the statutory guarantee of conformity provided for under Articles L217-3 et seq. of the French Consumer Code, as well as the guarantee against hidden defects provided for under Articles 1641 et seq. of the French Civil Code.

If a product does not conform to the order, is defective or presents an issue covered by the statutory guarantees, the Customer is invited to contact the Seller as soon as possible and, where possible, provide photographs showing the problem.

After reviewing the request, the Seller shall propose an appropriate solution in accordance with the applicable legal provisions. Depending on the circumstances, this may include repair, replacement, collection of the product or a refund.

Inspection of the apparent condition of the product at the time of delivery does not deprive the Customer of the benefit of the statutory guarantees.

Article 9. Liability

The Seller cannot be held liable for any damage resulting from the use of the Internet, including loss of data, intrusion, viruses or interruption of service.

Article 10. Intellectual property

All elements of the coeurdecollection.fr website, including its texts, images, graphics and logo, are the exclusive property of La Collectionnerie. Any total or partial reproduction is prohibited without prior written authorisation.

Article 11. Personal data

The Seller processes the Customer’s personal data in accordance with the General Data Protection Regulation. The Customer has the right to access, rectify, erase and object to the processing of their data, as well as the right to data portability. These rights may be exercised by post or by email at: contact@lacollectionnerie.com

Article 12. Complaints and mediation

In the event of a dispute between the Customer and the company, the parties shall endeavour to resolve the matter amicably. The Customer shall submit a written complaint to the professional or, where applicable, to the professional’s Customer Relations Department.

If no amicable agreement is reached, or if the professional fails to respond within a reasonable period of one month, a consumer Customer within the meaning of Article L.612-2 of the French Consumer Code may, where the dispute remains unresolved, refer the matter free of charge to the competent mediator included on the list of mediators established by the French Consumer Mediation Evaluation and Control Commission pursuant to Article L.615-1 of the French Consumer Code, namely:

La Société Médiation Professionnelle
mediateur-consommation-smp.fr
Alteritae
5 rue Salvaing
12000 Rodez, France

Article 13. Applicable law and jurisdiction

These Terms and Conditions of Sale are governed by French law. In the event of a dispute, and where no amicable resolution can be reached, the French courts shall have jurisdiction in accordance with the ordinary rules of jurisdiction.
